A leading land agent based in Edinburgh contacted Geo-Info Ltd to investigate the position of a newly erected fence at a property that was part of a newly constructed development abutting farmland.
It was believed that a new fence had been erected outside of the curtilage of the property and had encroached onto the farmland.
Geo-Info attended site and measured the position of the original fence which was constructed at the same time as the house, the newly erected fence and the position of the building as a check. To enable the survey to be carried out without accessing the land in contention reflectorless survey methods were used. The survey was positioned to Ordnance Survey coordinates by survey grade GNSS receiver enabling direct comparison with the Land Registry title plan.
The plan produced clearly shows that both fences fall within the registered title of the newly built property. The surveyed position of the building tied in to within a couple of inches of the Land Registry position.Therefore, no encroachment had taken place on to the farmland.
